The CBD oils consist of a cannabidiol extract organic associated with an oil base, usually vegetable oil. Thanks to the fatty substance in which the CBD is mixed (hemp oil or MCT coconut oil in particular), the latter is more easily assimilated by the human body : we speak of a fat-soluble molecule (it is diluted in fat, but not in water).

Buying CBD hemp oil gives you two options: one oil with a CBD isolate (high percentage of CBD) or a full spectrum oil (full spectrum) which associates the CBD other cannabinoids naturally present in the legal cannabis plant. The effects are then more pronounced thanks to theentourage effect.

CBD oils are definitely one of the most versatile and easy ways to consume cannabidiol. Different types of grip are available to you:

  • CBD oil sublingually : the fastest way to feel the effects. Place a few drops under the tongue, wait 30 to 40 seconds, then swallow.
  • CBD oil in capsules : just swallow them and then wait for digestion. The effects appear later, but the dosage is pre-established and the taking is extremely easy.
  • CBD oil in cooking : ideal for masking the taste. Place them on a sugar, in a spoonful of honey or in any dish.
  • CBD oil in local application : directly on the skin, to relieve skin irritation, or by massage.

The percentage of a CBD oil corresponds to its concentration: the higher it is, the “stronger” the product. It is therefore to be adapted according to your needs.

  • CBD oils 5% to 10%: rather for people who are new to CBD and want to take advantage of its gentle effects.
  • CBD oils 15% or 20%: they require fewer drops for such strong effects. For example, they begin to be interesting against pain, while benefiting from a proportionally more attractive price than the lowest concentrations.
  • CBD oils 25%, 30% and more: the most concentrated oils are reserved for those who are already familiar with CBD and need a higher dosage to achieve the desired effects.

Is CBD legal in France & Where to Buy it

In this buyers’ guide, we clarify the rules regarding the purchase of CBD in France, provide details on some of the most reputable CBD brands available in the region, and share insights on the best places to buy CBD products.

Dr. Emma F. Stone is passionate about plant medicine and the potential it holds in transforming the current medical paradigm. She has written extensively for Leafly, Weedmaps, Flowertown, Psychedelic Science Review, and contributed to industry reports and fact sheets detailing cannabis medicine, dosage, and delivery methods for diverse conditions. She’s currently working on a book exploring plant medicine and its uses.

Here are our key findings

  • Industrial hemp containing less than 0.2% THC can be legally cultivated in France. CBD can only be extracted from the stems or seeds of the plant..
  • The sale and processing of hemp flowers and leaves is prohibited in France.
  • Companies selling CBD are prohibited frommaking any therapeutic claims not recognized by France’s medical regulatory agency, the ANSM.

France is one of the hemp and CBD powerhouses of Europe, producing approximately 70% of the region’s hemp supply. Industrial hemp, or chanvre, as it is known in French, is legal in France provided that it contains less than 0.2% THC. All hemp grown in France must also be cultivated from government approved breeds.

CBD products derived from industrial hemp, however, must contain zero THC. This rule is stringently enforced: shops selling CBD with THC content may see their goods confiscated, or be closed down. That being said, a wide array of high-quality CBD isolate and broad spectrum products (free of THC) are available in France. There are several categories of product that are off-limits, however: dried hemp flowers and leaves containing CBD are illegal. CBD edibles are also off the menu, due to prohibition under the Novel Food Regulation, which extends throughout Europe.

This Leafreport guide will reveal some of the highest-quality CBD brands that are available in France. We’ll also unpack some of the complexities of French laws concerning the retail of CBD, so you can purchase and consume CBD with ease of mind. Let’s dive in!

Is CBD oil legal in France?

Like many countries in Europe, CBD law in France can be somewhat cryptic. However, the country has recently undergone some landmark court cases in relation to CBD that are helping to clarify the country’s stance in relation to CBD products. France is also expected to make some new legislative proposals regarding CBD in the near future.

Industrial hemp, from which CBD is derived, can be legally grown in France on the condition that it contains less than 0.2% THC content. All industrial hemp must also be cultivated from approximately 20 government-approved cultivars.

French citizens may also grow their own CBD-rich hemp provided it meets the above conditions, but only the seeds, stalks, and fibers of the plant can be used–not the flowers.

CBD products derived from industrial hemp, however, must contain zero THC content. Products containing THC are viewed as a narcotic, while CBD isolate and broad spectrum products without THC can be legally purchased and consumed throughout France.

Any stores that sell products containing THC may have their goods confiscated, or be closed down. French consumers who order CBD products online that contain THC may also find their packages confiscated by customs. It’s also important to note that the sale of dried hemp flowers or leaves containing CBD is illegal. The ANSM, (L’Agence Nationale de Sécurité du Médicament et des Produits de Santé), which is responsible for regulating health and medical products in France, has also prohibited any companies that sell CBD from making therapeutic claims.

While not explicitly stated, edibles also exist in an area of legal ambiguity in France. The European Commission added cannabinoids to the EU Novel Food Catalogue in January 2019. Under this regulation, edibles containing CBD are considered Novel Foods and can only be sold if they have been authorized by the European Commission.

CBD legislation in France 2022

The most recent law in France from December 30th 2021

Since December 30th 2021, commercial CBD products derived from hemp are legal as long as they have less than 0,3% tetrahydrocannabinol (THC). This is the first part of the decree’s purpose on the article R. 5132-86 of the Code de la Santé Publique.

Partly, it clarifies the CBD products’ legality since they were not defined by french law. Simultaneously, the second part attempted to prohibit production and sale of CBD flower, which affected negatively both France’s hemp market and CBD’s reputation in France.

French State Council suspended the decree in 2022

The attempt to ban CBD flower has created a lot of confusion around CBD, which is why so many asked whether CBD was legal in France or not. In reality, it is merely CBD flower. However, CBD industry brought proceedings before the French Council of State to suspend and annul the decree. On the 24th of January 2022, the State Council decided that the law was too harsh and unnecessary. Thus, they did suspend the decree indefinitely and CBD, including hemp flower, is protected by EU’s laws, like it used to be.

CBD in France and EU law

The reason CBD has had long legal battles between the french government and different shops is because the molecule is protected by EU law. EU is a single-market with free movement of goods. Consequently, a product legally produced in one country can’t be prohibited by another member. In november 2020, the Court of Justice of the European Union declared that attempts to prohibit CBD flowers were contrary to EU’s fundamental principles. This is the main reason why CBD, whatever the form, is legal in France as long as it is below 0,3% THC.
